Welcome to Marcelo Marques Coaching (marcelomarquescoaching.com). By booking a discovery call, purchasing a single session, or purchasing a multi-session package, you agree to comply with and be bound by the following Terms and Conditions.
Please read these terms carefully before engaging our services.
1. Scope of Services and Medical Disclaimer
1.1. Coaching Definition: Coaching is a professional, forward-focused, and action-oriented partnership designed to help clients develop personal resilience, rebuild identity, and establish purpose following significant life transitions or cancer treatment.
1.2. Not Medical or Psychological Treatment: Coaching services provided by Marcelo Marques do not constitute medical advice, medical diagnosis, psychotherapy, psychoanalysis, or clinical mental health treatment.
- Coaching is not a substitute for care provided by an oncologist, general practitioner (GP), psychiatrist, or licensed clinical therapist.
- You are advised to continue all prescribed medical treatments, routine check-ups, and professional mental health support.
- If you disclose active mental health crisis or clinical distress, Marcelo Marques reserves the right to suspend coaching and refer you to appropriate healthcare professionals or national helplines including NHS 111, Samaritans 116 123, or Macmillan Cancer Support 0808 808 00 00.
2. Your Right to Cancel (Consumer Contracts Regulations 2013)
If you are a consumer (not purchasing for business purposes), you have the right to cancel your booking within 14 calendar days of purchase without giving a reason.
However, if you request that we begin providing services within this 14-day period, and you subsequently cancel, you will be liable to pay for any services already delivered on a pro-rata basis.
Digital products: By completing your purchase and downloading a digital product (including workbooks and guides), you acknowledge that the right to cancel does not apply, as delivery is immediate and the product is fully accessible upon download.

3. Bookings, Payments and Refunds
3.1. Discovery Calls: Initial 30-minute discovery calls are complimentary and carry no obligation to purchase further services.
3.2. Individual Sessions and Packages:
- Single sessions and coaching packages must be paid in full prior to the start of the scheduled session unless a formal instalment plan has been agreed in writing.
- Package sessions must be used within 6 months of purchase unless otherwise agreed in writing.
3.3. Corporate Programmes (e.g. Return to Thrive):
- Corporate engagements, workshops, and organisational coaching are governed by bespoke commercial contracts issued directly to the client organisation.
3.4. Digital Products:
- No refund is available once a digital product has been downloaded.
- If you experience a technical problem preventing download, please contact us within 48 hours and we will resolve it promptly.
4. Rescheduling, Cancellation and Punctuality
4.1. 48-Hour Rescheduling Policy:
- For one-to-one sessions, we require at least 48 hours notice to reschedule or cancel a session without penalty.
- If you give less than 48 hours notice, or fail to attend a scheduled session, the session fee will be forfeited or deducted from your package total.
4.2. Late Arrival:
- If you arrive late for an online session, the session will still end at the originally scheduled time so as not to impact subsequent clients.
- If you are more than 15 minutes late without notice, the session will be treated as a missed appointment and forfeited.
4.3. Cancellation by Coach:
- In the rare event that Marcelo Marques needs to cancel or reschedule a session due to illness or emergency, you will be notified as soon as possible and offered an alternative session date or a full refund for that specific session.
5. Confidentiality and Data Protection
5.1. Confidentiality Standard: All information shared within individual coaching sessions is kept strictly confidential in accordance with professional coaching ethics and ICF standards.
5.2. Exceptions to Confidentiality: Confidentiality may be broken only under exceptional circumstances where:
- There is a clear and immediate risk of serious physical harm to yourself or others.
- Required by UK law or court order.
5.3. Data Protection: All personal data is processed in accordance with our Privacy Policy and UK GDPR guidelines.
6. Intellectual Property
All materials, reflection guides, course slides, workbook tools, and intellectual property provided by Marcelo Marques Coaching — including Return to Thrive materials — remain the exclusive property of Marcelo Marques Coaching.
Materials provided are for your personal, non-commercial use only and may not be reproduced, shared, sold, or distributed without explicit written permission.
7. Limitation of Liability
Coaching outcomes depend on individual commitment, personal action, and circumstances outside the coach's control. Marcelo Marques Coaching makes no guarantees, explicit or implied, regarding specific life outcomes, career changes, or health results.
To the fullest extent permitted by UK law, Marcelo Marques Coaching shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your participation in coaching sessions or reliance on information provided on our website or course materials.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
8. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
